1. Acceptance of Terms
By accessing or using Ahia Marketplace ("Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
We reserve the right to update these Terms at any time. We will notify you of material changes. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
2. Eligibility & Age Requirements
Ahia Marketplace is a global platform available to users worldwide. To use our Platform, you must:
- Be at least 13 years old. Users aged 13–17 must have verifiable parental or guardian consent before using the Platform and registering an account.
- Users who wish to buy or sell on the Platform must be 18 years old or older, or have explicit written parental/guardian consent where permitted by local law.
- Have the legal capacity to enter into a binding contract under the laws of your country of residence.
- Provide accurate and complete registration information.
- Not be prohibited from using the Platform under applicable local, national, or international laws.
We do not knowingly permit children under 13 to create accounts. If we discover that a user is under 13, we will promptly delete their account and any associated data.
3. Account Registration
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your information as needed
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
We reserve the right to suspend or terminate accounts that violate these Terms or that we believe pose a security or legal risk.
4. Buyer Terms
4.1 Purchasing
- You agree to pay for all items purchased through the Platform
- Prices are displayed in the currency supported in your region. The Platform supports multiple currencies; the displayed currency may vary based on your location and the seller's listing.
- Payment must be completed before order processing begins
4.2 Escrow Protection
- Payments are held in escrow until you confirm receipt of goods
- You must confirm delivery within 7 days of receiving your order
- Disputes must be raised within the confirmation period
4.3 Refunds & Returns
- Refund eligibility depends on seller policies and dispute outcomes
- Products must be returned in original condition when applicable
- Shipping costs for returns may be borne by the buyer or seller depending on the circumstances of the dispute
- Refunds are subject to the consumer protection laws applicable in your jurisdiction
5. Seller Terms
5.1 Seller Requirements
- Complete the seller verification process
- Provide accurate product descriptions and images
- Honor listed prices and shipping terms
- Ship products within stated timeframes
- Respond to customer inquiries promptly
- Comply with all applicable export, import, and trade laws in your jurisdiction
5.2 Prohibited Products
You may not list or sell:
- Illegal items or controlled substances
- Counterfeit, stolen, or fraudulently obtained goods
- Weapons, explosives, or dangerous materials
- Adult content or services
- Items that infringe intellectual property rights
- Hazardous, toxic, or regulated materials
- Items prohibited by the laws of the seller's or buyer's jurisdiction
5.3 Fees & Payments
- Platform fees are deducted from successful sales as published in our fee schedule
- Funds are released to sellers after buyer confirmation
- Withdrawal requests are processed within 1–3 business days, subject to applicable banking and regulatory timelines in your region
6. Prohibited Conduct
Users must not:
- Violate any applicable local, national, or international laws or regulations
- Engage in fraudulent or deceptive activities
- Harass, threaten, bully, or abuse other users
- Post false, misleading, or defamatory information
- Attempt to manipulate reviews, ratings, or rankings
- Circumvent security measures or access controls
- Use bots, scrapers, or automated systems without our express permission
- Infringe on intellectual property rights
- Share personal data of other users without consent
7. Dispute Resolution
In the event of a dispute between buyers and sellers:
- First, attempt to resolve the matter directly with the other party through our messaging system
- If unresolved, open a formal dispute through the Platform within the allowed timeframe
- Provide supporting evidence (photographs, messages, tracking information, etc.)
- Our dispute resolution team will review all evidence and make a determination
- Decisions by our dispute resolution team are final within the Platform
Nothing in this section limits any statutory rights you may have under the consumer protection laws of your country.
8. Intellectual Property
All content on the Platform, including logos, text, graphics, software, and interfaces, is owned by Ahia Marketplace or its licensors and is protected by applicable intellectual property laws worldwide.
By posting content on the Platform, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content solely for the purpose of operating the Platform.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- We provide the Platform "as is" without warranties of any kind
- We are not liable for disputes, losses, or damages arising from transactions between users
- We are not responsible for product quality, accuracy of listings, or delivery outcomes
- Our aggregate liability to any user is limited to the fees paid by that user to us in the 12 months preceding the claim
Some jurisdictions do not allow certain limitations of liability. In such cases, our liability is limited to the fullest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Ahia Marketplace and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any content you post or transmit through the Platform
11. Termination
We may suspend or terminate your access at any time for violation of these Terms, at our discretion, or as required by law.
Upon termination:
- Your right to access the Platform ceases immediately
- Pending transactions may be cancelled or completed at our discretion
- Outstanding seller funds may be held pending resolution of any open disputes
- Sections that by their nature should survive termination will remain in effect
12. Governing Law & Jurisdiction
Ahia Marketplace is a global platform. These Terms are primarily governed by the laws of the Federal Republic of Nigeria, where Ahia Marketplace is incorporated and operated.
However, we acknowledge and respect applicable consumer protection and privacy laws in your country of residence, including but not limited to:
- The General Data Protection Regulation (GDPR) for users in the European Economic Area
- The California Consumer Privacy Act (CCPA) for California residents
- The Children's Online Privacy Protection Act (COPPA) for users in the United States
- Applicable consumer protection laws in your local jurisdiction
Disputes not resolved through our internal process may be referred to arbitration or the courts of Nigeria, except where mandatory local consumer law grants you the right to proceed in your home jurisdiction.
13. Changes to These Terms
We may update these Terms periodically. We will provide reasonable notice of material changes via email or in-app notification. The "Last Updated" date at the top of this page indicates when the Terms were last revised.
